A 19-year-old Sacramento man was shot and killed early this morning as he tried to break into a North Sacramento home, police said.
The resident inside fired a shotgun through a door, striking the invader, police said.
Sacramento Police Lt. James Beezley said the resident called 911 at 12:18 a.m. to report that two men were trying to break into his house in the 800 block of Carmelita Avenue off Rio Linda Boulevard. One of the men was carrying a rifle and trying to jam it through the door, which was slightly ajar, the resident reported to authorities.
Beezley said the resident fired the shotgun once through the door, striking one of the suspects in the torso. The injured man staggered about 50 yards away from the house and collapsed on the street.
Paramedics pronounced him dead at the scene.
Police officers were unable to find the second suspect when they arrived.
Beezley said it did not appear that the robbery suspects and the resident knew one another.

B) We don’t have a castle law so I hope the guy said, a) I feared for my life and b) I looked through the peephole and saw they were armed. Otherwise, I’m afraid he’ll get charged. Anyone know for sure?

You are correct. In Kali, one has a “duty to retreat” even in your own home. You have to be trapped, and in the process of being physically attacked with a weapon after being clearly notified by the bad guy of his intent before the state allows you to defend yourself.

California Penal Code Section 197:
197. Homicide is also justifiable when committed by any person in
any of the following cases:
1. When resisting any attempt to murder any person, or to commit a
felony, or to do some great bodily injury upon any person; or,
2. When committed in defense of habitation, property, or person,
against one who manifestly intends or endeavors, by violence or
surprise, to commit a felony, or against one who manifestly intends
and endeavors, in a violent, riotous or tumultuous manner, to enter
the habitation of another for the purpose of offering violence to any
person therein; or,
3. When committed in the lawful defense of such person, or of a
wife or husband, parent, child, master, mistress, or servant of such
person, when there is reasonable ground to apprehend a design to
commit a felony or to do some great bodily injury, and imminent
danger of such design being accomplished; but such person, or the
person in whose behalf the defense was made, if he was the assailant
or engaged in mutual combat, must really and in good faith have
endeavored to decline any further struggle before the homicide was
committed; or,
4. When necessarily committed in attempting, by lawful ways and
means, to apprehend any person for any felony committed, or in
lawfully suppressing any riot, or in lawfully keeping and preserving
the peace.
That information is legally incorrect.
California has no such duty to retreat within your own home.

Looks like the shooter belives in gun control..He had total control of his gun when he shot the POS !! Good for him, we need more people in control of their guns.
