I know you are innocent until proved guilty but in a case like this where someone questions your eligibility for a public office, wouldn't you have to produce unquestionable proof? Any lawyers out there want to ans. my ?

And that’s why the DNC is named.

Obama Campaign claims that the lawsuit has been dismissed are false. The lawsuit is proceding through the federal courts.

I'm not a lawyer but I did stay in a ... oh never mind.

Here is the order in Hollander v. McCain dismissing a similar suit against McCain. In this order the court set out the threshold a plaintiff would need to meet to have standing. Read the order if you want to know why Mr. Berg doesn't have standing.

Innocent until proven guilty only applies in the criminal context. This is not a criminal case, i.e. it is not the state against a person, but it is a civil case, i.e. person versus person.
