No, she was acquitted by the jury.

Ronny Earle brought the charges as a political hit job, and tried to get some type of plea out of Hutchison. She said she was not guilty, and went to trial. Earle lost his nerve, and when the trial Judge said "The State will call its first witness." Earle refused to do so. As the State refused to produce any evidence, the Judge sent the jury out with an instruction that, since the State could not possibly have met its burden of prrof, they were to return a "Not Guilty" verdict, which they did.

Later, Earle complained that because the Judge had refused to rule, in advance of trial, what evidence he would admit, he was afraid of what the Judge would do. The Judge, a retired Judge of the Texas Court of Criminal Appeals, and a Democrat, said "The only thing (Earle) had to fear was that I would follow the law."

As I recall, the meat of the charges was that Hutchison had used a State computer to write, and possibly print, letters that were political, and not related to State business. Frankly, she probably did. But this at a time when Governor Richards was running a political campaign out of the Governor's Mansion, and Gary Mauro, the State Land Commissioner, had State employees, working on State time, and using State credit cards, to further Bill Clinton's 1992 campaign in Texas.

It Earle had indicted all three, he would have had no greater fan than me. If he had indicted none of them, then at least he would have consistent. By indicting only Hutchison, he clearly showed himself to be a political hack, misusing his office for partisan gain.

Charges were indeed dropped. This was another of the trumped-up charges and malicious indictments by Travis County DA Ronnie Earle, who is notorious for abusing the power of his office in vendettas against political foes.

Kay was charged with improper use of state phones for campaign purposes. (A major violation of the public trust. /s) He dropped charges for lack of evidence on the day the trial was to begin, after the defendants and taxpayers had incurred major costs preparing for the trial.

This was before the republicans had their stupid rule about indicted Congressmen being read out of the leadership. Tom Delay was a victim of Ronnie Earle and this rule.

This indictment, if examined at all, is an example of democrat corruption, not republican corruption.
