I do understand that this suit is designed to stop his nomination. Time is of the essence to the plaintiff. My guess is he’d be asking for a preliminary injunction against the nomination of Obama pending the outcome of his case. I doubt if he has sufficient evidence of Obama’s constitutional ineligibility for the judge to grant him such an injunction.

You are still missing the point. His gambit is to stop the nomination politically, not legally. The wheels of justice grind very slowly, so he has little hope of stopping it legally inside a week. However, if he can plant enough doubt in the super-delegates mind, then the political winds can stop the nomination. Especially since the Clintons got Hillary a roll-call vote.
