ANN ARBOR, MI The Thomas More Law Center, a national, public interest law firm based in Ann Arbor, Michigan, yesterday filed its answer brief in response to the prosecutions appeal of the Military Judges ruling, dismissing the case against LtCol Jeffrey Chessani, USMC based on unlawful command influence.

I heard that the U.S. Government spent 36 million dollars in order to prosecute lt. col Chessani. Johhny Sutton is a worthless, ego-driven, POS.
Johnny Sutton must not be able to sleep at night.

"An objective, private citizen, fully informed of the facts and circumstances of the Haditha cases would see the prosecution of LtCol Chessani as one motivated by politics and not justice. This observer--which there are many, as a simple review of public comments on this case reveals--would conclude that his suspicions about the military justice system are correct: it is fixed system where justice is secondary to achieving the desired result of those in positions of high command. Consequently, the military courts-- and its system of justice--require that the Military Judge be the last sentinel to ensure not only that the actual command influence does not taint the process, but even the appearance of unlawful command influence is absent. The credibility of the military justice system requires nothing less.
"At the present moment one would concluded that the military justice system has not failed in this case. And that is because of Col Steven Folsom, USMC, the Military Judge presiding, has taken his duty and responsibilities quite seriously. Far from being immune to command pressures, a Military Judge on active duty is often in a very difficult position, particularly in a high-profile case such as this one. Despite this tremendous pressure, the Military Judge ruled according to the facts and law and properly dismissed the case. That ruling should not be disturbed, lest this Court is willing to perpetuate the public's eroding confidence in military justice."
I donate regularly to the Thomas More Law Center. They do a lot of good work.
It’s outrageous that they have to spend more money on this case, while that stinking prosecutor wastes millions of our taxpayer dollars dragging this case on and on and on.

Amen to that! Haven't read the whole thing yet but am looking forward to it.
The brief is a little tough going (for this nonlawyer anyway) but definitely repays the effort.
