USA: Texas execution violates international law

The execution of José Ernesto Medellín Rojas by the state of Texas is a violation of international law, said Amnesty International today. "It undermines the authority of the International Court of Justice (ICJ) which had ruled in favour of a stay of execution."

In a six - three decision (Justices Breyer, Souter and Ginsburg dissenting) the Supreme Court held that even though the ICJ’s Avena decision “constitutes an international law obligation on the part of the United States,” (emphasis in original) the President lacked the requisite authority to compel States to comply with it.

Mixed decision. While it dismisses authority of ICJ over state matters, it seems to assert that ICJ would have authority over federal executions.
