Judge tosses suit against McCain over citizenship

CONCORD – A federal judge dismissed Thursday a Nashua man's legal challenge that Republican presidential nominee-to-be Sen. John McCain, R-Ariz., was ineligible because he was born in the Panama Canal Zone.

The article begs the question that I have been asking on some of the Obama birth certificate threads. Which branch of gov’t. (and who) has the jurisdiction to ensure that the Constitutional requirements for qualification as POTUS are met?

If I was the judge I would have made the plaintiff pay all court costs as well. This idiot didn’t read one letter of U.S. citizenship law before he filed this suit.

My belief is that the only body that can make that determination is the Electoral College. The only reason why the US Supreme Court was involved in Gore v. Bush was a reaching decision by the Florida state supreme court, and SCOTUS went out of it’s way to imply that this decision would be /only/ for this one particular case.

Believe me! I don't like John McCain a whole lot more than I don't like anybody else on either side in this election!

But this suit is just plain frivolous. And the Judge shouldn't have been praising this basket case, he should have been penalizing him for wasting taxpayer dollars.

Born on a US military base, to American parents, one of which was military personnel stationed on the base certainly qualifies as an American citizen in my book.

Glad it got pitched.

Well, we don’t vote for president, we vote for electors who are promised to a particular candidate. For a primary election, I think that a state court could rule on eligibility to be on the ballot, but most states have specific rules on who can be a candidate and most do not include anything about being a natural born citizen, only being a US citizen, and it’s even questionable if a state could disallow someone who has citizenship.

But ultimately, yeah, the only body that has the power to make this decision is the electoral college prior to the election, and after the election, impeachment could be used.

The rules of state POLITICAL parties determine who will appear on primary ballots. They could have Mickey Mouse there if they so desired. What I’m interested in is WHO or WHAT enforces the US Constitution with regard to presidential requirements. I’ve never heard that the Electoral College is a law enforcement body.

It would seem to me that the office where the candidate registers his/her candidacy would be the entity first responsible for determining whether a candidate is eligible to run.
