Allyson,
I’m so sorry to hear about your nephew; I can’t imagine the trauma he must be going through after such an event. Please keep us updated.
I heard the MA AG on the radio, answering questions from callers. Someone called in and expressed displeasure that the dad in this story had been arrested. The AG said that we have the right of self defense but not of "self help" which seemed, as she used it, to mean revenge. She said once the perp was confronted and no longer posed any danger, the dad had no right to take any action but should just have waited for help from police.
Then one of the radio hosts chimed in that the real trauma to the child comes from seeing his father react with violence rather than from being approached lewdly by strangers in a public bathroom.
I think I am reporting this accurately. I heard this in the car about a week ago.
i would articulate that i reasonably belived that my son was in imminent physical danger and took steps to counteract the danger by subduing the assailant.
Even in Massachuesetts one cannot come to the aid of a third party to prevent feloneous [sexual] assault?
Maybe the old pedophile gets a pass in Mass because Mass is "So Gay."
