Savage needs to argue the Supreme Court actions on the basis of The Constitution. The Constitution specifically allows for capital punishment, so they've again made up something that's not in the Constitution. However, Savage's argument and personal outrage, though genuine and certainly understandable, is not what the Justices should consider, or else they go the other way in inventing laws from the bench. BTW,

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; Amendment V.
