According to World Net Daily, it looks like the honorable Marines who had their name drug thru the mud by dis-honorable Jack Murtha may be looking to sue him for libel and defamation.
When Fat Jack stood up there in May of 2006, jowls a-swinging, and declared that those Marines had killed innocent Iraqi citizens “in cold blood,” he had tried and convicted our honorable Marines without due process for all the world to hear. He gave an immeasurable amount of aid and comfort to our enemies. He is a traitor. For that, more than ex-marine Murtha’s jowls should swing.

One of the great benefits of of the surge is tha fact that our troops now conduct “joint operations” with Iraqi forces. This has led to stop to these kinds of charges since there are now Iraqi military on hand who can vouch for the actions of our guys.
When Iraqi Army officers and NCO’s can say “it happened the way the Americans said it did”, the jihadist propaganda warriors at MSNBC have no place to run with their trumped-up atrocity stories.

If you have the time I would like you view on the chances of success in their suit against Murtha. I would think it has passed the "Absence of Malice" test by many leagues?

Unfortunately during military operations in a country where the enemy hides behind civilian dress codes (as would a saboteur) during his semi hidden operations, civilians are going to always get caught in the cross fire. I refer back to the Korean War where the north Korean infiltrators utilized the civilian mass of humanity who were fleeing south to get out of the way of the oncoming conflict. The un-uniformed enemy (North Koreans) hid among them to gain advantage in combat as now do the enemy in Arab garb. To me this is cowardice among the Arab fighters who do not think the lives of women,children,and elderly civilians are worth while as did the North Koreans in there pursuit of conquest.
The civilian do gooders here in America, including those illustrious members of Congress (Rep. Murtha, D-PA) should allow our worthy troops to conduct this war to its end by taking off the gloves and be totally ruthless with regard to the this type of enemy.

You are absolutely right that Jack (The Mouth) Murtha has long since passed the absence of malice standard. However, there is the pesky Speech and Debate Clause of the Constitution. However reprehensible his remarks are, they are absolutely privileged if said on the House floor, or in conjunction with House business.
His potential liability depends on whether he repeated those remarks in venues away from official House business. I think he did. And if so, a jury should nail him for a fat amount.
