I don't think insanity, however defined, should be used as a criteria to establish guilt or innocence. A trial should be used to determine true facts, either that a defendant did a thing as accused, beyond a reasonable doubt, or did not. A defendant's mental state should be considered in determining what punishment, if any, fits the crime.
