The amicus McCain proudly brags about signing explicitly states that while the 2Nd is an individual Right, that Congress retains the power to bloody well in fringe on it if they want.

Further, if Congress had passed the legislation over turning the ban, the SCOTUS would not have had the chance to hear the case and potentially clear up 70 years worth of asinine bad laws that blatantly infringe RKBA at all levels of government.
