Texas judge walks off bench; when FLDS children will return is unknown

The devil was in the details.

Discussions about a proposed order involving the return of children taken from the Fundamentalist LDS Church's YFZ Ranch broke down late this afternoon when attorneys for the families wanted to review proposed changes with their clients.

Judge Barbara Walther announced the attorneys had better get all of their clients' signatures before she would sign the agreement and abruptly left the bench late this afternoon.

A lawyer for the families, Laura Shockley, said she expected attorneys would return to an Austin appeals court Monday to push for an order returning the children. It was the 3rd Court of Appeals that said Walther should not have ordered the children to be removed from the ranch and warned that if Walther failed to act, they would do it for her.

Lawyers for the families said that an agreement had been tentatively reached with Child Protective Services when they walked into court earlier today. Walther, however, expressed concerns about the proposed agreement and called an hourlong recess. She then returned to the bench with her own proposed order.

That led to concerns from many family attorneys who raised objections and questions on behalf of their clients.

The judge added additional restrictions to the the agreement, including psychological evaluations and allowing CPS to do inspections at the children's home at any time. Several of the more than 100 attorneys in the courtroom and patched into the hearing through phone lines objected to the judge's additions.

"The court does not have the power, with all due respect, to enter any other order (other than vacating)," said Julie Balovich of the Texas RioGrande Legal Aid over the telephone. She argued that no evidence justifying the additional restrictions had been entered as evidence before the judge.

After reviewing the appellate court decision, Walther returned to the bench and announced she believed the Supreme Court's decision upholding the appellate court decision gave her the authority to impose whatever conditions she feels are necessary.

"The Supreme Court does say this court can place restrictions on the parents. I do not read that this decision says that this court is required to have another hearing to do that. You may interpret that however you choose."

With that, the judge abruptly left the bench, saying she would await any submitted orders.

Immediately, attorneys in the courtroom and over the phone, expressed confusion.

"What did she say?" one attorney asked.

"Do We have another hearing?"

"What did she order?"

No additional hearings are currently scheduled. The judge signed no orders that would allow for the release of any children.

Lawyers for CPS left the courthouse declining to speak about the hearing.

"I'm going to do what the court directed," said CPS attorney Gary Banks.

And he showed me how much he could still do after our last hurricane. We cut trees for two weeks straight after the storm and he hung with me every minute even though I had 30 years on him. LOL

The ironic part of that is neither of us had any trees down in our own yards.

They don’t make many men like him- or likely you any more. These young boys- even many of the ranch boys are not the tough stock we are used to seeing. The city boys I know are total couch potatoes though so I guess country boys still have them beat in the real men department. Not to say there aren’t real men in town working blue collar jobs and even some white collar jobs- but they are scarcer.

Attorneys for Jeffs argue that incest charges should be dismissed because Arizona laws require both participants to be 18 years old or older.

???? It's not incest if the girl is under 18? Doesn't seem too likely, but then again the law doesn't have to make sense.

Of course you conveniently left off the next sentence.

If a judge agrees, Jeffs would still face charges as an accomplice to sexual conduct with a minor.

Since that story was May 10, and his court date was May 16th, it's likely been resolved by now.... although a quick didn't show that it has been.

Jeffs may be a scumbag, but he certainly seems to have the sort of legal team I'd want defending me.

get Army Surplus clothes

RealTree or similar hunting camo would also look just as nasty. And probably be about as effective in hiding from the two legged variety of coyote. But again, a variety matched to your territory. You could pick it up at WalMart about as cheaply as getting MilSurp.

don't forget what FDR did in wwII with the Japanese. he rounded them up and put them in camps....

Yep, my torturer's physical therapist's parents were put in such a camp. Her Dad and/or Uncle(s) (I forget) left the camp to fight in the European theater. She herself is a retired Army Lieutenant Colonel. My Orthopedic surgeon is also retired Army, and they knew each other on active duty, but when he had both his knees replaced, he wouldn't let her near him. I like to say she learned both the Western and Eastern methods of torture physical therapy. She has a sign on the wall of her torture chamber treatment room, that says "Whining" overlaid with the slashed circle.

That was an excerpt, a reply to someone who had specifically brought up the subject of incest; stating that he/she didn’t think that the FLDS was involved in such things. I did post a link for anyone who was interested in reading the entire original story.

Isn’t that something - no incest charges because the girl is younger than 18. Who’d a thought . . .

I read somewhere that the request was denied but I haven’t heard anything about the trial yet. I’m sure it’ll be covered intensely once it begins.

Yeah, that would be a big kink in my plan- I wonder how many horses it would take to pull that thing?

Fuel economy would be one advantage of one of those V-100 "War Wagons", they use standard auto gas, or automotive diesel (the came both ways), and should get mileage not much worse than a large SUV. (You gotta give up something for the armor protection.

Another alternative would be to rebuild a light truck with a fiberglass body, so that it looked like a "War Wagon", and if you used Kevlar instead of or in a sandwich with glass fiber, you might even get some protection against AK type rounds.

Yeah, you could have left that part out!

It's the best part. And a standard "trick" of Air Force survival instructors. They'd eat one, and then ask if any of the "students" wanted to eat the other. In this case our FTO happened to be with that subgroup (the flight had been divided into three groups of about 8 each, by "Counting off") EC asked if he ate one, would the FTO take away some demerits? (he had a bunch built up that week). The FTO, being an evil type, like they are trained to be, (he was actually a nice guy, for a steely eyed missile man), said , yeah 5 demerits if you eat it. He did, and then asked, can lose some more demerits if I eat some more eyeballs. FTO, said sure. So the rest of us were treated to the sight and sound of "surfer dude", El Cajon, the future undertaker remember, running down the hill toward each of the other two campsites, yelling "Do you have any eyeballs left?" We did, and he lost another 10 demerits. IIRC, he still had to walk tours that Saturday after parade.

See, you teased the story out of me after all... I'll not mention the details of eating eyeballs to avoid offending your delicate sensibilities. :)

Oh no, that would never work- those big guys likely would cost more to feed than the fuel would cost. How many cow ponies do you think it would take? We already have several of them.

This one from farther down looks even more likely to do the job. Same breed, they just look better suited, even though about 300 lbs lighter (each) IMHO.

Building one, now that is a plan- hubby could do that, and likely has all the parts it takes in the junk pile already. Only problem with that is he will put in down the list to work on fences and horse trailers and things of that type and it would take forever for him to finish it. I’ve been trying to get him to build me a horseshoe lamp for about 5 years and it hasn’t come up on his list yet- so if I want one of these I’d better buy it. It’s a real shame too, because I am certain he could build one that would be perfect for the Redneck SWAT team look.

Those being lighter would likely eat less. I don’t think they would make too good of cow ponies in the down time though.

I don’t think they would make too good of cow ponies in the down time though.

don't sell the Belgian horses short if you ever git a chance you will find them very smooth riding and while not a cutting horse if you have to rope anything of size they can hold it

But can they catch up to the cattle so you can get them roped to begin with? There are cattle here that can outrun some of the slower cow ponies. I bet the cows would really move out if they saw those big guys approaching.
