Opposition forms against gay marriage rights in NY

Opposition is forming against Gov. David Paterson's directive to state agencies to recognize gay marriages legally performed in other states and countries.

The Rev. Duane Motley of New Yorkers for Constitutional Freedoms says the Democratic governor is circumventing the Legislature and courts and slapping New Yorkers in the face.

granting government benefits to gay couples will come at a cost to the state even as Paterson calls for cuts in spending because of looming deficits.

I say let the liberal state governments keep this crap up. It will only help the Republicans in November.

I don’t understand this happening in New York at all. Reason being, the New York Court of Appeal, their highest court in that state, has already ruled against same-sex marriage. There was a lawsuit similar to Calif. and Mass. a couple of years ago in New York. Their court ruled against same-sex marriage.

Since their highest court ruled against same-sex marriage, how in the sam hill can their governor issue an executive order to recognize same-sex marriage performed elsewhere?
It makes no legal sense; i.e. gay marriage is not legal in New York, but it will be legal if you got legally married somewhere else.

I don’t see how the governor can give legal recognition to something that his state courts have ruled is not legal.

Is it just me, or have you also noticed that these “advances” are being caused by judicial or executive decrees rather than by the grass roots?

Yes you are right, these “advances” are being caused by judges or executive orders.

This case in New York is brazen because, their highest state court had already ruled against same-sex marriage in a lawsuit over the definition of marriage. So, ignoring that, this governor decided to do things through the back door and say that they will recognize out of state or out of country same sex marriage. He knows New York state can’t do the marriages, but he’s saying they will be recognized if performed elsewhere.

Can somebody please go back to court and ask that the court order on same-sex marriage be clarified so as to exclude this kind of executive order nonsense?

New York's highest court – the Court of Appeals – refused to review a lower-court ruling that ordered recognition of so-called foreign "same-sex marriages" performed outside the State of New York. Such unions must now be honored in New York if they were created legally -- for example, in Massachusetts or Canada.
