What the SF ruling said was that there was no compelling reason that gays should be made second class citizens. Even the dissenters agree with the idea of same sex marriage but felt there may not be enough reason, at this time, to reverse the lower courts decision.

Gays are not second class citizens. Just non gays (whatever the hell that means) they can marry anybody they choose so long as the person is of the opposite sex, proper age and not a close blood relation.

The dissenters understand that judges do not make laws based on "their ideas". They also understand that fundamental rights are those rights with a long tradition of being rights in America. The definition of marriage is one man + one woman. That is the fundamental right established by long tradition in America.

What your pals did was to ignore long standing jurisprudence vis a vis fundamental rights and and the will of the people of California as provided in a referundum 8 years ago in favor of "their own ideas".

It's called fascism.

And by the way you have no idea of what separation of powers entails. But here’s a clue. Judges do not get to make new law based on “their own ideas”.

The following are the powers of the Judiciary: the power to try federal cases and interpret the laws of the nation in those cases; the power to declare any law or executive act unconstitutional.

The word "unconstitutional" is not in the text of the Constitution. The Supreme Court asserted (grabbed) the power of reviewing legislation; it is not granted to the judiciary under the Constitution.
