According to this article, the answers to your first two questions are yes and yes. As for your third question I don't know but I don't see how that is relevant unless we have a law on the books that mandates jail time for all welfare recipients whose children fail to get a HSD.

I suspect there is more to this story. Not sure if I agree with what the judge did, but it’s impossible to say without knowing all the details.
