Thank God that level heads and common sense has prevailed.
If you want law enforcement then send cops. If you want to fight an enemy, blow stuff up, and kill things then send military. Our military should never be put in this position where they have to make split second decisions and then be charged in criminal proceedings for their actions.

These cases where more than one Soldier or Marine who fired their weapon at the scene gets charged with premeditated murder, then one or more gets his charges dropped to a slap on the hand in exchange for damning testimony is getting to be a little too predictable and way too common to be isolated incidents IMO.
It's the only way a case can be made out thin air, and I think that recruits should, as part of their training, study the prevalence of this sort of confession/accusation mining, warning them that not only may they one day see their mates blown up around them by the enemy, but that on another, they may be given a choice; to lie about the guy who's been covering their back all those months or spend the rest of their life in prison.
Perhaps this jury recognized the procedure.
