Adults moms to stay with nursing FLDS infants; children to still be home-schooled

In deviations from the normal practice in child-removal cases, infants removed from the YFZ Ranch will not be separated from their adult mothers if they are still nursing, and older children will continue to be home-schooled in their foster placements.

The details, revealed at an informational gathering today presided over by 51st District Judge Barbara Walther, appeared to defuse much of the tension that had been building between attorneys for the hundreds of children housed at the San Angelo Coliseum and the state's Child Protective Services agency.

"I would like for this case to take on the normal progressions these things take," Walther told a crammed courtroom of more than 60 attorneys and reporters. "The Department (of Family and Protective Services) has been stretched beyond belief."

CPS attorney Gary Banks told Walther the agency planned to separate nursing infants from their adult mothers, an idea she rejected. Those 18 mothers should be placed with their babies, she said.

Likewise, Banks said, CPS plans to break from its normal practice of allowing children placed in foster care to be enrolled in public schools.

"They might down the road be in the school system," he said, noting the "cultural shock" the children likely would feel, "but right now, the plan is not to do that."

Attorneys after the meeting said they were glad to see information exchanged, and Walther said she expects communication to improve between CPS and the attorneys as the case begins to break down into smaller groups.

Local attorney Tom Goff said he agrees with that sentiment.

"It's just overwhelming," he said. "I think it'll settle down."

I know for a fact that in the state of Michigan, if there is a complaint made they have 24 hrs to investigate. If the worker feels the complaint is accurate, all of the children are removed from their home.

The parents don’t get to see the kids until the matter is straightened out.

I don’t believe the children get their own attorney who works for their interest.

The worker is the sole decision maker. They especially like to go to the school and talk to the kids alone. Sometimes the kids are taken right then and there.

I know of a case where the parents went to school to pick up the kids and they were just plain not there. They’d been removed by the State.

Why do these moms get better representation than other states do? And why are they wanting special treatment?

No, actually this article is about the judge’s ruling.

CPS had one thing in mind, and the judge rejected it.

why don’t you go ahead and reread the story and the part where the CPS lost while trying to separate infants STILL NURSING from their mothers before spewing your religious rhetoric please. /sarc off

I am in agreement with the judge on this. I wasn’t necessarily trying to debate...just putting out my opinion. I apologize if it came across as a poke at you.

I think it's because of the communal enviornment. They can't place a child with a parent or parents because one or both have been giving false information.

The judge called for attorneys to represent each child's best interest.

They want special treatment because they ‘want their children back,’ even though they won't give DNA to prove they are their children.

Well, it comes as a surprise to me that children in a dispute like this aren’t always granted legal representation. I know in many states they are. Shame on Michigan for not giving children a legal advocate.

I believe it is CPS’s policy to completely remove a child from a parent, if the judge finds the environment to be unsafe. There is no age limit on this policy that I know of.

Judge Walther has again, shown compassion and leniency.

The key is IF the environment is unsafe. There weren’t any reports of sex with infants, though it may have happened. The judge was right to determine that a nursing infant is safer with the mother than being put with a new family who is unfamiliar.

While this is not an inmate situation, it is a perp and enablers of perps situation; you'll note that Uncle Sam doesn't accommodate folks with a "Nursing Mothers" Jail section, either.

If your wife was a nursing mom, & you took her to live within a compound where neither of you reported upon obvious cases of statutory rape, you, too, could be the equal opportunity "wonderful beneficiaries" of governmental bureaucratic policies in action. Bureaucracies like the CPS weren't designed to be Customized Compassion Inc., religious folks were...and if the "religious" folks in this case missed out in being a neighbor to underaged girls, then the "unneighborly" realities are pressed upon the broader community...the immediate community just about ALWAYS suffers for the actions of individuals & the non-actions of the watchers.
