Was the Cold War illegal?

Cold war wasn't declared as a war no. Therefore things like Jane Fonda going over to Vietnam never got punished. You guys are all misreading what I'm trying to say so I guess I'll start over:

We should have declared war.
Then we won't have to deal with all the sedition we have.
Then we can win the war.
Then we can declare the war over.


It's a good formula worked well in the world wars. If we fight Iraq like we fought Vietnam then eventually detractors will erode the will of the republic and we'll lose by quitting. I don't want that to happen. Instead we have people on our street corners shouting behead those who insult Islam etc etc.
