Three FBI agents were finishing a meeting with a female federal prosecutor in the federal courthouse in Boston in 2006 when one of them came up behind her, wrapped his arm around her neck and gave her a Three Stooges-style noogie, according to several law enforcement officials.
Now, after a yearlong investigation by the Justice Department into whether the incident was foolish horseplay, bullying, or harassment, the FBI has concluded that all three of the male agents should be fired, said the officials, speaking on condition of anonymity.
Investigators from the inspector general's office found that FBI Supervisory Agent Robert Callen, who was overseeing the Boston office's organized crime squad at the time of the incident, acted inappropriately when he put his hands on the prosecutor.
They also determined that Callen and the other agents, whose identities were not disclosed, were not truthful when questioned about what happened, according to officials.
Callen, who has been an agent for more than 20 years and is eligible to retire in June, and the two other agents may appeal the decision within the FBI, officials said. They have 60 days to file an appeal after being notified of their proposed termination, officials said.
"No one has been fired," said Gail Marcinkiewicz, a spokeswoman for the FBI's Boston office, when asked about the incident yesterday. "Because this is an administrative matter, we will not be able to discuss it any further."
Acting US Attorney Michael K. Loucks also declined to comment on the matter, citing privacy concerns. He asked the Globe to withhold the name of the prosecutor.
The case has inflamed tensions between the FBI's Boston office and the US attorney's office, law enforcement officials said.

I thought the justice department said that federal agents were above the law. Now we learn they are only above the law when they shoot women and children. If they embarrass a federal prosecutor they should be terminated immediately.
It took a year to figure this out? Wonder what it cost? Inquiring minds, etc.
Remember guys, treat your female co-workers as one of the guys or get fired. Or is don’t think of female coworkers as one of the guys but don’t treat her as one? Don’t treat or think or is it? Oh what the Hell, don’t work.

Heck, it could have been worse. He could have given her a 'Wet Willie', or, heaven forbid -- a Wedgie.
That really would have gotten .... her panties in a bunch.
If I’d done anything of the sort back when I was doing the 9-5 thing, I’d have been fired on the spot for grossly unprofessional behavior and very poor judgment, and would be lucky as hell to avoid a sexual harassment suit in the process.

Women or men, shouldn’t matter. A professional on the job has a responsibility to act in a professional matter. Raise that an order of magnitude when the job comes with a badge, and another order of magnitude when it comes with a gun.
If a co-worker did such a thing to me, he would experience a rapid and unexpected rise in his calcium intake.
What in the world are you talking about? This should have had NOTHING to do with the attorney being a woman. There is nothing sexual about giving someone a “Three Stooges-style noogie.” So the standard here unlike a sexual harrassment case is should this guy be fired had he done this to any federal assistant prosecutor male or female.
That makes it less clear to me. To me the answer is yes, if he was trying to physically intimidate the prosecutor to do what he personally or the FBI wanted more of the time. And again to me the answer is no, if he was just teasing the person and not trying to intimidate them.
As far as the other agents who were less than truthful, you do understand this is not a criminal matter, don’t you? I will say I would hold FBI agents to a very very high standard since the Federal government are sending people to prison for lying to the FBI. So maybe the two who were not truthful should be fired but the “noogier” should not be.
I agree. A person shouldn't touch anyone else at work, male or female, without their permission.
It still works that way in the private world. Horseplay? After hours ... don't touch a woman at work ... how hard is that to adhere to?
I wonder if this means W could get in trouble for the back rub he gave to Angela Merkel, or maybe it’s just good to be the president.
