Wasn't there a video of this incident that clearly showed the vic bending down and rising up with his hand cocked to throw? It was posted here on FR late last year.

Or was that a different case? It sounds like the same one.

If it is, the jury obviously was not shown that video.

I am sure there are a lot of jurors who would convict if the agent shot him for getting ready to throw a stone.

Different case, Sam. That one was in San Diego along the fence.

The incidents were within a week or two of each other, so FReepers and others frequently confused the two.

There is video in this case, too...but it is from a camera more than a mile away and is not clear enough to support either side in this trial.
