To be absolutely precise, Nifong got a court order to force the ENTIRE team to submit to DNA testing (except the lone black player). He promised that the DNA tests would reveal the guilty players. When that didn't work he gave her a rigged lineup from which she ID'd her three "attackers".

Meanwhile, what was Duke doing?

338. At the same time, Duke Police investigators were compiling information Duke University’s records on the three renters of 610 N. Buchanan, Plaintiffs, their teammates, and relaying the information to Durham Police.

339. Duke Police compiled a CD-ROM of all of the identification photos of members of the lacrosse team that were kept by the Athletics Department.

343. On March 16, 2006 at 9:30 a. Smith, Duke Police Sergeant Defendant Smith provided a CD their teammates for identification entitled “Duke PD Report.”

344. Duke University gave the keys to the home at 610 N. Buchanan Blvd. to the Durham investigators.

Actually she ID'd FOUR attackers. One of the three in this suit was that 4th person she ID'd. He wasn't even at the party so they didn't go after an indictment of him.
