Jesus wasn’t quiet on the cross. He said to the one thief who expressed belief, the he would be with Him (Jesus) immediately in Paradise. These were thieves, not murder’s., so why would the death penalty even come up?

They were all given the death penalty. Hanging on the cross was death. Excruciating death. Yet, Jesus said nothing about it being unjust. When the one thief said, “We deserve our punishment” Jesus did not disagree.
