he should have been arrested the first time he was caught, perps that are americans plead down to lower charges, but from what i’ve seen in the criminal justice system very few get complete immunity from committing a crime to testify about another “crime” (which i believe that they were acting lawfully)

If he had been caught the first time, he would have been prosecuted for the drugs that were seized in the van he was driving.
Unfortunately, the two BP agents on the scene were unable to aprehend the single unarmed man, even after they shot him in the backside piercing his urethra.
More unfortunately, they were unable to provide any useful description of the man.
So if you are upset about him not being arrested, you should blame Ramos and Compean for that.
Without catching him, and without the BP agents being able to give a description or identify him, it was impossible to arrest him or to get him extradicted. We only KNEW about him because a report through relatives got back to officials telling of the shooting, which they were unaware of as it had not been reported.
There was nothing lost giving him immunity for his testimony, as there was no evidence available to show he was guilty, without his testimony.
It is fortunate that he was caught committing another crime, and that Sutton was able to get him arrested. He will now serve time, something we all wanted.
