Vallejo -- Openly gay Vallejo City Councilman Gary Cloutier won the mayor's race by four votes, elections officials said this afternoon, just hours after the councilman apologized for his weekend arrest for public intoxication after drinking too much at a bar in Palm Springs.

Cloutier beat former Solano County supervisor Osby Davis by a hair-thin margin of 5,722 to 5,718 votes, according to final results from the Nov. 6 election. Assistant registrar of voters Lindsay McWilliams said he expects to certify the results as final on Monday.

The mayor's race has been in a virtual dead heat since Nov. 6, when Cloutier and Davis were tied in their bids to lead the Bay Area's ninth-largest city.

"I'm elated by the results," Cloutier, 45, said in a brief phone interview. He said he would not declare victory before the election is certified.

Davis, 62, a real estate attorney aiming to become the city's first African American mayor, has indicated he will ask for a recount. He could not immediately be reached for comment today.

At a brief news conference in Vallejo this morning, Cloutier promised to restore the public's confidence in him after his arrest Sunday. A civil rights attorney and two-term City Councilman, Cloutier was arrested after he allegedly stumbled out of the Palm Springs club and got behind the wheel of a Cadillac, police said.

"I made a mistake that I deeply regret," Cloutier said this morning outside the Vallejo City Hall. "I had too much to drink.... I make no excuses and I accept full responsibility for my actions. I have embarrassed myself, concerned my colleagues and disappointed my supporters. I deeply regret my actions, and apologize to the people I've let down, especially those who have worked so hard on my campaign.

And how many illegal aliens tried to vote/were able to vote?

(Didn’t expect to see good ole Vallejo in the news.)

Some background here.

He appears to be a gay Democrat who made his reputation some time back suing doctors and dentists who refused to treat patients with AIDs.

""I'm elated by the results,"

And if I had lost, I would have been so angry I could peel a grape.

I don’t care who is under his desk or in his bed. I do care that he doesn’t have enough common sense to avoid drinking and driving. I have spent a good portion of my career cleaning up the messes left by drunk drivers. Anyone who would get behind the wheel after drinking too much, does not deserve to be elected for anything.

That’s funny. The activities that don’t bother you have caused more disease and death, LOL.

As a FF/Paramedic I see a lot of death and devastation from drinking and driving. For every person killed by a drunk driver, there are several more that are seriously injured, and harmed irreparably.

No matter what I feel religiously, I don’t see how his choice of partners causes harm to anyone else. It is between him and God. A drunk driver can and often does cause pain, suffering and destruction to others. To me that is a whole different ball game.

That’s funny. The activities that don’t bother you have caused more disease and death, LOL. For example:

Syphilis, spurred by unsafe sex among gay men, rose 14 percent in the U.S. last year and the government said chlamydia cases topped 1 million, the most ever reported for a sexually transmitted disease.

The syphilis increase was the sixth reported annually since 2000, when prevalence hit an all-time low, the U.S. Centers for Disease Control and Prevention said in a report today. About two-thirds of syphilis case last year were in homosexual men, according to the annual report.

Sexually transmitted diseases cost almost $15 billion a year to treat in the U.S., and more than half of those infected are 15 to 24 years old, the Atlanta-based agency said.

If it was just between him and God, he'd still be in the closet.

He's a homosexual? I've been watching this guy on local newscasts since this past weekend when he was arrested, and this is the first time I have seen or heard anyone refer to him as gay!

When I saw him on the news in the press conference pictured above, I was wondering if he was drunk again. He has a slow and ve-ry de-lib-er-ate way-of tal-king.

I don’t see where he has any of these diseases. You are making assumptions that all gay men have these diseases and this is not the case. I don’t care to continue this because it is a waste of time. Anyone who does not see drinking and driving as the very serious misjudgement that it is, is not someone I can communicate with. How you can compare someone who might pass along an STD with someone who might kill innocent children and adults, and tear apart the lives of innocent families just doesn’t make sense to me.
