THE SORDID saga of Larry Craig in the bathroom stall seems certain to continue, now that the Idaho Republican senator has reversed his decision to resign and said he will serve the remainder of his term. Mr. Craig's zigzags have only added to the circus atmosphere...
All that said, this was Mr. Craig's call and he is entitled to make it. For the same reasons that we had qualms about the basis for his prosecution, we think demands that he leave or be ousted from the Senate are overblown and unwarranted. Mr. Craig's behavior in a Minneapolis airport restroom was almost certainly the prelude to something criminal -- not homosexual conduct but sex in a public place -- but we are sympathetic to his argument that the ballet of toe-tapping did not rise to the level of criminal disorderly conduct.
Mr. Craig's lawyer, Stanley Brand, notes that the ethics panel has never taken up a case involving a misdemeanor, much less one that has nothing to do with a lawmaker's official duties. The ethics committee should think more than twice before getting involved in an investigation of Mr. Craig's unseemly escapades.

You can impeach the President for a misdemeanor. Of course that was written in the old days, you know Washington, Jefferson, Adam’s. People not enlighten like us now.
Let’s see if Congress can stiffen up and put it to Craig, or see if Congress is the pillow biter.
Of course the Republicans in theory could do something, but that would require Party standards, of which there are none.
The WashCompost is salivating thinking of yet another seat up for a Dem takeover next year. Immediately after Sen. Warner’s announcement of his illness, CNN was shameless in quoting doctors who said that Sen. Warner should not continue his term because of his brain condition, yet it was perfectly fine for Sen. Johnson (D-S.D.) to continue to hold his seat while he has been absent for over a year with a stroke. That these msm Dem mouthpieces are taken seriously by anyone is disheartening.
That said, Craig is a selfish, ego-driven character for his betrayal of trust and utter lack of shame in holding his office and paycheck until the bitter end. Too bad Idaho does not have the power of a recall petition.

There are more than a few Republicans in the same toe tapper’s club. Craig knows who they are. So does Hillary for that matter...

Formerly announce he's out of the party and remove his committe positions.
Run the ads and start the recall of the senator in his home state. Slate a candidate and make him the lead in this.
Force a expulsion vote in the Senate. This would allow the repubs to remove craig while forcing the dems to to make a stand on this and they are not all in safe degeneerate districts..
Then again they could act as though nothing has happened and plod along until the media smears this all over again during the general election. This will be their course of action, since its simply easier to do nothing.

I can’t recall a US Senator being recalled. Is this possible? Where is the enabling legislation or Constitutional provision for this?
In the old days the state legislator would have already replaced him out of embarrassment.

Although the Supreme Court has not needed to directly address the subject of recall of Members of Congress, other Supreme Court decisions, as well as the weight of other judicial and administrative decisions, rulings and opinions, indicate that: (1) the right to remove a Member of Congress before the expiration of his or her constitutionally established term of office is one which resides exclusively in each House of Congress as established in the expulsion clause of the United States Constitution, and (2) the length and number of the terms of office for federal officials, established and agreed upon by the States in the Constitution creating that Federal Government, may not be unilaterally changed by an individual State, such as through the enactment of a recall provision or a term limitation for a United States Senator or Representative. Under Supreme Court constitutional interpretation, since individual States never had the original sovereign authority to unilaterally change the terms and conditions of service of federal officials agreed to and established in the Constitution, such a power could not be reserved under the 10th Amendment.
