Feds' Porn Ultimatum
NY Post ^ | August 19, 2007 | By JANON FISHER

Ron Jeremy, Jenna Jameson - get ready to stand and be counted.

The Department of Justice wants to come up with an official list of every porn star in America - and slap stiff penalties on producers who don't cooperate.

The new rules, proposed under the Adam Walsh Child Safety and Protection Act, would require blue-movie makers to keep photos, stage names, professional names, maiden names, aliases, nicknames and ages on file for the inspection of the department's Child Exploitation and Obscenity Section.

"The identity of every performer is critical to determining and ensuring that no performer is a minor," according to the new proposal.

The adult film industry plans to challenge the new rule as a violation of the First Amendment, said Paul Cambria, a lawyer for Hustler and other adult film companies.

He sees it as a way to harass legitimate stag-film producers.

"If they can't get you for obscenity, they'll get you for violating record-keeping," he said. Such a violation would carry a five-year penalty.

The proposed rule would require porn producers to give the title of the video or magazine, or the Web address where the actor appears.

The Department of Justice has shown some sensitivity for the performers' privacy, however. All information not essential to proving their age and identity, like phone numbers and addresses, can be withheld.

Distributors of foreign pornography aren't off the hook - they must still produce a copy of the foreign actor's identification card. The department estimates that there are 500,000 Web sites, 200 DVD producers and 5,000 businesses nationwide that would be subject to the new rule.

The Constitution does not provide rights at all — it enumerates the powers of the federal government. Except for matters of interstate commerce, there is no federal government power to regulate obscenity.

I’ve never claimed obscenity was free speech. What it is, though, is impossible to define at a federal level. Legally, it is only possible to define it based on community standards.

Even the first pic is completely different from her earlier days.

I had never seen her prior to her "coming out" as an "author". But even in that short period she's undergone noticeable changes.

They're passing the law to keep kids out of the porn business. Who does the author use as examples in their article? Ron Jeremy? Jenna Jameson? The Hedgehog is 54 frickin' years old! Jenna Jameson is 33!!

Well, I have been know to watch an occasional adult feature presentation back in the day. She was an extremely beautiful, young woman when she started. Now, she looks ill and jaded.

Exploitation tends to do that to a person.

There's no right in the Constitution to produce obscene material.

...so this is what they’re doing instead of tracking down illegal aliens.

You must not realize how valuable an index of porn-stars names,
addresses and home phone numbers are to the US Congress and other
members of our government.

Especially when they are "on the people's business" in Southern
California.

(yes, I'm being sarcastic/facetious...but I wouldn't be suprised if
some guvmint folks wouldn't like to "make a social call" to folks
on the registry now and then)

Seriously, this is the sort of thing that makes most conservatives gnash their teeth, and for the wrong reason.

1) It sounds like they are pandering to conservatives. And they are. It is insulting for them to think we are too dumb to know that they are ignoring what we really want on serious issues, the making some trivial gesture they think will make us “dumb rednecks” forget about the big stuff. Offering us the old felt hat full of shiny nickels instead of the check for $100, like they used to do to sharecroppers in the reconstruction South.

2) With literally HUNDREDS of SEVERE criminal charges that could have been leveled at Bill Clinton, Ken Starr ignored everything else and concentrated on one act of petty, gross and stupid sexual activity. He didn’t even pay attention to RAPE, just some lame crap. He threw the game, and the whole nation lost. He didn’t even try to investigate the real crimes, just waste time and money so nobody else could. A local DA from Podunk could have secured two dozen convictions in that time without hardly trying.

3) We are in the middle of the War on Terror, and the occupation of Iraq and Afghanistan. Terrorists are trying to infiltrate our country, espionage has returned to Cold War levels, our borders are overrun with illegal aliens, surveillance and government power are at new all time highs, and the Justice Department has employees who are so under used that they have time for nonsense like this.

4) Any more, whenever anyone in the federal government even mentions child pornography, the ONLY thing it means is that they don’t want to do their job. It is the equivalent of a congressional resolution in support of the chicken industry.

We need to get rid of this administration while we still have some shreds of the Constitution left.

Yeah, that’s it - add a rider to this stupid law requiring them to keep the data on 1964-vintage computers. What nursing homes will they have to troll through to find mainframe operators who can still change an IBM 2311 disk drive?

Like this is really going to cure the problem?

Nanny State Ping.

I oppose child porn and am revulsed by it as much as the next person, but just like gun laws, it won’t do a thing about those who are breaking the law as it is, they won’t abide by this.

This won’t serve any purpose, other than to spend more of our tax dollars. We have enough bureaucracies wasting our money without producing any benefits.

This is the one thing wrong with the conservative movement, they preach less government invasion unless it involves sex. Remember that wonderful Meese commission on pornography. I love how they appointed such people with such an unbiased opinion like porn fighters Henry Hudson and Dr. James Dobson. The ironic thing was one of the people on the committee who preached against the sins of porno was Father Bruce Ritter who was convicted of having sex with minors.
