I gather the prosecution has a weak case-regardless of how the public might feel.

Looks to me like the DA wimped out. Unless he's counting on the US attorney to bring charges on the bogus papers. Wonder where that stands? Undocumented. Snort.

This looks like a normal prosecution to me: charge of DWI upgraded to involuntary manslaughter;immigration detainer lodged.

Being here illegally is a misdemeanor offense.Possession of false documents would upgrade that to (possibly) a low-grade felony-normally resolved via deportation.

For comparison’s sake, assume the DWI driver was a US citizen, but had an outstanding warrant for criminal trespass on gov’t property. The major charge to be dealt with is still the DWI-related death.
