The cases differ in a crucial way: unlike Schiavo, Devlin signed a health care proxy during his health crisis. Nevertheless, debate persists about who should carry out his wishes, and how.

In his July 2004 proxy, Devlin, who was diagnosed with esophageal cancer, gave control of his medical treatment to his brother, Dan Devlin.

Ten months later, Al Devlin suffered severe brain damage during surgery to remove cancerous tissue. Soon after, his wife successfully sued for control of her husband's treatment.

Earlier this week, state Appellate Justice Salvatore Martoche denied Dan Devlin's appeal of that ruling. Devlin said he may next take his case to the state's highest court, the Court of Appeals, or to a federal court.

"If a judge is able to get away with this, a (proxy) is useless," he said.

Mr. Devlin having esophageal cancer probably cannot speak. This seems imo to be one way of using their inability to communicate against the patient. And, as World Net Daily pointed out, a living will can kill you prematurely or there's another scenario - said document is fraudulently voided by committee or a spouse who is opposed to natural death. Shame!

I was by the deathhaus the other day. I drove through the parking lot and then back out. I prayed for the woman who will spend her last days in there. I just did a drive by prayer since I am no friend of hospice sarcophagus (looks like a big tomb). 6670 102nd Ave. N. Pinellas Park, FL. Where TERRI WAS MURDERED.

WOW!! ~ Thanks, 8mm! Talk about an eye-opener. So just when you think you have it all figured out, tell someone what your wishes are for treatment or not, something happens and they can still take away the proxy!????? prayers up!!
