I heard here on FR before the 2006 elections, how it would be good if the democrats took over the majority to teach the republicans a lesson. Yeah, good idea. Nothing in the constitution says the Supreme court has to be balanced. Twenty years of the Warren court tought us this.

The irony is that currently the Supreme Court is balanced. Four conservatives standing for the Constitution, four liberals opposing it, and one swing vote (Kennedy).
