What's the law?

His statement: "It is understood that [a parent's] drug addiction, child abuse, prostitution, belonging to a satanic sect or heterosexual affair would negatively affect the children and serve as a reason for a change of custody," said Ferrin Calamita according to the Spanish news agency EFE. "Well, it's the same with homosexuality,"

Sounds as if there is leeway here. Unless of course you're a protected degenerate group.

DID his views override their (the Spanish) law? What law specifically? Law gets created over time. Unless the Spanish government has always been in favor of homosexual unions, which I am unaware it has been, or he didn’t violate a law. It is more likely someone is testing the law and he - the judge - said no to their idea.

I objected to the tone of the suggestion - because it was clear they were asking for the judge to be investigated because they disagreed with his decision. That’s asking the government to abuse its power. If they have some case for the judge regularly overruling law in Spain (like, for instance, our 9th Circuit, with 86% of its decisions being overturned), then they should present that. But that’s not how it sounded to me in the article.
