This lawsuit is flat, it will be squashed. The lawyers for Catepiller will crush it. Right from the very start you can tell this claim will collapse, the squeeze is in.
Without ever seeing the inside of a law school, I could defend this case for Caterpillar in two sentences.
(1) The United States Courts courts generally have no jurisdiction over events occurring in locations outside the United States. (Yes, there are exceptions, but they don't apply here.)
(2) Caterpillar violated no U. S. statute in selling its equipment to Israel.
