She didn’t ‘suffer’ the 86 minute execution, either. It seems she is suing in the name of her son, who DID commit the crimes.

I’m not a lawyer, but it seems she would have to establish a probate in her son’s name to sue in his behalf. Therefore, any proceeds to his estate should be counter-suable by survivors of his victim(s).
