Where the First Amendment is implicated, the tie goes to the speaker, not the censor.

Isn’t it superb to have an AMERICAN PATRIOT THAT FOLLOWS AND PROTECTS CONSTITUTIONAL LAW speaking out. To hell with those socialist leftists on the SCOTUS. They foul the air.

Considering that the ads were aired in the blackout period before an election where Feingold was running, asking voters to contact their Senators and tell them to stop filibustering judicial nominations, it is both no wonder that Alito and Roberts found the ban unconstitutional, but also a sweet in your face for Feingold.

The court also ruled against Madison, WI-based Freedom from Religion in another case today, rejecting a challenge to President Bush's faith-based initiatives.

In its 5-4 decision, the court said the foundation lacked the legal standing to challenge funds the Office of Faith-Based and Community Initiatives spent on conferences and speeches.

The office funds social programs put on by religious and community groups. Officials of the Wisconsin foundation maintained that the office's spending on conferences and speeches had the effect of promoting religious groups over secular ones.

The separation-of-church-and-state case hinged on whether an average taxpayer could allege violations of the First Amendment's establishment clause, which states: "Congress shall make no law respecting the establishment of religion."

Congress did not set up the office. It was Bush, in an executive order early in his presidency, who created the White House office and several centers within federal agencies to ensure that faith-based community groups were eligible to compete for federal money.
