The boy cannot consent either, so neither go to jail.
How much better off will you be if the pre-teen boyfriend is jailed? I think there’s just gotta be a better thing for government to be doing than jailing pre-teens for what pre-teens sometimes do.

I remember being a pretty young kid and negotiating that territory.
It is hard for our society to let kids be kids. When we were kids, we snapped girls bra staps and such. Nowadays it would be in the newspaper.
I think it is sad.
In the eyes of the law they are both victims so don't make an issue of a non-issue. You also need to not take this too lightly. Pre-teens can learn and follow basic moral values. When you give that up the problem increases. Big shock.
Funny how many people accept that they can't be moral but insist they can learn to take all the necessary precautions.
This doc is preaching to the choir. She needs to address lawmakers in states and on the Federal level. They are the ones tying parents hands. After all not all parents can homeschool or afford private school.

Kids these days are growing up too fast — in more ways than one. American girls are reaching puberty up to a year earlier than in previous generations, with some children showing signs of sexual development as young as age 3. In extreme cases, girls are budding breasts before they’ve even learned to read.
Researchers call this phenomenon “precocious puberty,” which some say is on the rise. Forty-eight percent of African-American girls and 15 percent of Caucasian girls show physical signs of puberty by age 8, according to a study of 17,000 U.S. girls published in Pediatrics in 1997. In a subsequent study of more than 2,000 boys, lead author Marcia Herman-Giddens found that 38 percent of African-American boys and 30 percent of Caucasian boys showed signs of sexual development by age 8.......snip
