Thursday, June 07, 2007 Senator Sessions Releases List of 20 Loopholes in the Senate Immigration Bill

U.S. Sen. Jeff Sessions (R-AL) released a list of 20 loopholes in the comprehensive immigration bill today which reveals that the bill is fatally flawed and will not establish a functioning immigration system in the future.

The list of loopholes includes flaws effecting border security, chain-migration and assimilation policies. The list exposes the lack of serious attention given to ensuring that the legislation fixes America’s failed immigration system.

“I am deeply concerned about the numerous loopholes we have found in this legislation. They are more than technical errors, but rather symptoms of a fundamentally flawed piece of legislation that stands no chance of actually fixing our broken immigration system,” Sessions said. “Many of the loopholes are indicative of a desire not to have the system work.”

For example, one loophole in the “enforcement trigger” fails to require the U.S. VISIT system – the biometric border check-in/check-out system established by Congress in 1996, but never implemented – to be fully functioning before new worker or amnesty programs begin. Without the system in place, the U.S. has no method of ensuring that workers and their families do not overstay their visas.

I just did the same. After reading these loopholes, I am more offended and angry than ever.. these Senators and Congressmen/women must truly believe that the American people are not very bright. I’ve been calling and now I will call even more!

When I read about the threats (I call it blackmail) now going on behind closed doors, I called Sessions’ office and told the aide that the whole country was behind him. The aide said they’d received thousands of calls from around the country. He also said that no matter what happens, Sessions will stand up for what he believes in, but that it will be an uphill fight.

Baloney! Writing things like this weakens your credibility. I believe that this bill is a disaster, you do too, and the majority of posters do as well. Watching this President for the last 7 years tells me he truly believes this is a good thing. He doesn't merely do the politically expedient thing. I respect him for that, but in this case I strongly disagree with him.

Another loophole is the one which allows alien jihadists in without a check on their status if they are ‘clean’ as far as international outlaw behavior and terrorist acts. They can come in without checks because we will not profile Muslims or Middle Easterners specifically in the bill, now federally, or in any state or local municipality. Police do not even want to ask anyone if they are illegal in sanctuary cities. Which btw , is another loophole that should have been closed. Federal law should outlaw state and city sanctuary movements.

Sessions isn't gonna win any popularity contests on the Hill after this, but his constituents deserve major kudos for putting and keeping him there. We need dozens more no-holds-barred conservatives of his caliber in Washington.

mtnwmn, thank you for posting this. I have copied and printed it out for further study.

My sincere question is this:

If our elected officials (including the current administration) have refused to adhere to the past bills and laws, why should we even consider trusting them to enforce the laws in this new (abhorrent) bill?

Example:

In October of last year - one billion dollars was allocated to build a 700+ mile fence to secure our borders. Only ten miles at the most has been built in the past eight months. So what happened to the BILLION dollars (and the 690 more miles)? Ask Senator John McCain:

Illegal aliens are not required to learn English to receive full “probationary benefits” of citizenship. Passing a basic English test is only required for the third Z-visa renewal, twelve years after amnesty is granted.”

A nice read...Thank you Sen Sessions. And to date I have not heard anyone answer the question I have had since day one. If I an illegal on the “path to citizenship fails to meet any of the requirements in the decad plus they have to comply, what then? Will they be deported? Personally I think not. After a decade or so it will simply be time for yet another phony plan.

That means we need to be writing letters, making calls, to each and every Senator whether they are ours or not. We cannot let up. Sessions’ 20 loopholes gives us good ammo.

Giving the Government 24 hours to justify denying amnesty is ridiculous.

The politicians on the Hill are laughing at anyone who believes their explanations for this.

Their implausible BS line is that it will encourage illegals to "come out of the shadows" because they know they'll be approved in a day or two.

No matter that they're already in "probationary status" and can't be deported whether the criminal check takes 24 hours or 24 days. They have immunity from apprehension and deportation regardless of how long the check takes.

And, since everyone concurs with law enforcement experts that background checks cannot be completed in 24 hours the second BS line is that they'll be done continuously so long as the subject has a Z visa.

Right. And I can get any immigrant a U.S. naturalization approval in less than 1 month, for only $500. /sarc

And one need not ask why an applicant would even care that the criminal check takes 24 hours or 2 weeks or 2 months. What's the difference, so long as they have probationary Z visa approval?

The difference, of course, is that our friendly illegal aliens are not completely stupid, and they'll know that a 24 hour check is far more likely to result in nothing, compared to a more thorough check that takes 30 days. That's an especially important distinction for those with criminal records, and they know it. They will "come out of the shadows" if they believe the criminal check is likely fail.

That's aside fromt he matter that there is no provision for a home country criminal clearance, and no system exists to check on a 27-year-old male who previously lived in Mexico City. Was he a rapist? A robber? A murderer? Who knows? Maybe, maybe not. The proposed 24 hour check using NCIC and fingerprints doesn't address that problem, nor is it required. So who cares.

It's possible that crimes in Honduras, Mexico, or Guatemala *might* hit on a criminal who's wanted by Interpol, but unlikely.

I guess if any big criminal ID problems arise, we can always count on our good friends in Mexican law enforcement to lend a hand.

Wow, interesting. I called his office too, after watching C-Span and how he seemed to be the main voice for us, the people. But the aide I talked to didn't say much, darn it.
