A second Los Angeles judge threw out the murder charge against a suspended USC student accused of killing her newborn child on Tuesday.
Holly Ashcraft, a 22-year-old architecture major who has stood trial for two years, still faces a June 27 hearing for one charge of child abuse.
Ashcraft was arrested in October 2005 after a newborn was found in a Dumpster behind the 29th Street Cafe. DNA evidence proved it was her son.
Prosecuting Deputy District Attorney Franco Barrata had cited a coroner's conclusion that the baby was born alive, but defense attorney Mark Geragos had repeatedly challenged that assertion in court.

The culture of death thrives in California. A self-indulgent women walks after the death of a second child, again under very suspicious circumstances. And her lawyer, Garagos...this guy is just scum.

Sad but typical that she values life so little.

Did you read the whole article? There is a lot of evidence pointing to a stillborn. There are conflicting opinions from various medical experts.
I’m not agreeing with her methods, just saying the evidence doesn’t support the charge.
BTW, the “culture of death” is thriving all over the country, what makes California so special to deserve your derision?

The culture of death thrives in California. California?
Andrea Yates -- Texas, Killed her five children
Ellen Feinberg -- Illinois, Killed one son, stabbed her other
Gabriel Estrada -- Texas, Killed her four children
Susan Smith -- South Carolina, Killed her two children
Another undeserved and cheap shot at California. Surprised you also did not spell it with a K.

Sigh... if only she had access to safe, affordable abortion on demand this wouldn’t have happened. When will California wake up? /extreme sarcasm

The culture of death thrives in California. Yes, but lets not forget, the perpetrator/murderer is from Montana.

"Did you read the whole article? There is a lot of evidence pointing to a stillborn. There are conflicting opinions from various medical experts."
There's also evidence the child was born alive. Considering that this is her second "stillborn" child, color me cynical here.
"BTW, the culture of death is thriving all over the country, what makes California so special to deserve your derision?"
Because so much of our national rot starts there, and then moves east. California is in a race with New England to see who can reach the lowest levels of depravity first. Oh, and I'm from California, thanks. I've since left (and you know as well as I do that I'm not alone...California is bleeding middle class citizens to other states. Immigration is the only thing keeping its population up), and I don't regret it.

even if stillborn, we don’t condone throwing dead babies in dumpsters - I would like to know what her field of study is at USC. Does she still have a shot for Homecoming Queen?

According to the Los Angeles Times, Ashcraft was investigated in 2004 for similar charges after she showed up at Good Samaritan Hospital having recently given birth, but without a baby.
She said the baby was stillborn, and police could never find the baby's body to verify her claim, the Times reported.
...........
At Ashcraft's arraignment in November 2005, nearly two-dozen family and friends showed up for support, and 36 letters were submitted to the judge on Ashcraft's behalf.
"She's one of those memorable kids," said Burton Pierce, Ashcraft's high school guidance counselor. "Probably [ranks in] the top 10 kids of all time that I've ever worked with academically." "Everyone [at the firm] couldn't be happier for her," said Wallin, who had also advised Ashcraft during the 2004 investigation.
"She's a wonderful young lady," he added. "From the very beginning of the case.
We always believed 100 percent that the district attorney would never be able to prove a homicide charge with the evidence in this case."
Hell...meet handbasket!
