California to permit conjugal visits for gay inmates

SAN FRANCISCO: Gay and lesbian prisoners in California will be allowed overnight visits with their partners under a new prison policy, believed to be the first time a U.S. state has allowed same-sex conjugal stays.

The policy comes more than two years after a 2003 California law provided equal rights for registered domestic partners in the state, including those of the same sex and nonmarried heterosexuals. Gay and civil rights groups had threatened to sue to permit the conjugal visits in prisons.

"It's a little troubling that a state agency had to be threatened with legal action to obey state law," said Geoff Kors, executive director of Equality California, a gay-rights organization. "There was no justifiable excuse for not complying."

Terry Thornton, a spokeswoman for the state Department of Corrections and Rehabilitation, said that slow pace of change resulted, in part, from concern over whether allowing the visits would expose gay inmates to danger inside the prison, where they are sometimes singled out for attack.

The policy change was spurred by a letter warning of legal action from the American Civil Liberties Union on behalf of Vernon Foeller, 40, a gay man who had been serving a 20-month sentence for attempted burglary.

Get ready to read this phrase more often when it comes to gay rights.

If A, then B. Then certainly C. And if you allow C, why are you against D? Also, isn't E, F, and G just a part of D? Why not them? And give me one good reason, given all the above, that H isn't allowed?

Wait until some convict or visitor sues the state because they contracted AIDS during one of these vsits. I wouldn’t want to be the inmate who has to change the sheets on those beds, or cleans the rooms/trailers used by these creeps. Also, if they are going to allow gay visitors and gay convicts to have conjugal visits on prison grounds, the next logical move is for gay convicts to sue the state of California to change their rules on sex between convicts within the prisons. Of course convicts have sexual relations all the time, but if caught in the act (which is rare), it usually results in disciplinary action. At least it did during the years I worked in NY State’s prison system. This is so wrong in so many ways. It makes me so glad that I retired back in ‘03, because NY State usually follows California’s prison policies eventually.
