Just Mr. Kervorkian, he probably figured that the laws did not apply to a flaming liberal. Maybe like Mr. Kervorkian, he will get out and decide that behaving civil is better than jail.

Authorities said Rust-Tierney used a computer in his 10-year-old son’s bedroom to view the files...

I'm probably like most people and have never seen the material we are talking about, and I hope I never do.
People who use real children in their materials are evil and need to be put down.
When the material is just fabricated, no one is harmed.
I do not have all the answers, but I have to wonder what is the lesser of two evils. Those who look at fake dirty pictures, or a government that jails people for viewing unauthorized pictures. It may well be a slippery slope what the government allows.
Prosecutors said yesterday that they had identified at least 30 child pornography victims shown in the images and videos Rust-Tierney downloaded and that the images were created in places ranging from England and Texas to Scranton, Pa. Rust-Tierney used his credit card to purchase the images from child pornography Web sites on at least five occasions, spending about $420.
At one point, court documents said, Rust-Tierney e-mailed the operators of a Web site requesting free access to a child pornography video normally sold separately for $100. The Web site operators e-mailed back with a link to the video.
Rust-Tierney’s plea agreement with prosecutors said the images he downloaded showed “sadistic or masochistic conduct.”

U.S. Magistrate Judge Theresa C. Buchanan, who declined to release Rust-Tierney at the hearing in March, had described the material on the computer as “the most perverted and nauseating and sickening type of child pornography” she has seen in 10 years on the bench.
This is the Virgina state chief. There are 49 other chiefs that are more than likely co-conspirators.

What this guy apparently repeated paid for...little girls ( pre-teen ? ) crying that they did not want to be raped, then getting repeated raped by adults for money on the video , etc. is beyond words.
He is lucky to not get life in prison.
This is not about his civil liberities but about the child victims.

It's harder to fake than you might think; I was recently involved in court case involving allegations of falsified data, and there was evidence that was available. That said, an out of control government will always have more power than an individual when the full force of the state is brought against them. Two seperate issues: 1) Should Child Porn be prosecuted? 2) Should government falsify evidence to convict people.
The falsifying of evidence can be done to show any crime, so what law is shown to be violated doesn't really matter. See the entire history of Stalin . . .

I'm not so concerned about his civil liberties, rather than our civil liberties. This guy is a steaming pile of dung. I just get nervous when the government jails people in general, not specifically in this case, for looking at dirty pictures. I see the need to get rid of freaks like this guy, and I can also see the need to keep the government in check, and I can also see the need to protect young folks from harm. I suppose it is all about the proper boundaries for a free society.

Or are you asking a peripheral question unrelated to the particulars this case?
I guess I'm confused because you keep bringing up the "fantasy" question.
