The American Civil Liberties Union has filed a lawsuit claiming Maricopa County officials have violated the rights of a quarantined tuberculosis patient for months by treating him like a criminal.
The U.S. District Court complaint filed Wednesday on behalf of Robert Daniels alleges that health officials and the Maricopa County Sheriffs Office have violated numerous constitutional rights and the Americans with Disabilities Act.
The suit seeks what it calls appropriate accommodations for Daniels, rather than severe and inhumane jail conditions.
Its good news for me, Daniels said Wednesday evening. I finally have a chance to get out of this black hole.
Robert England, the countys tuberculosis control officer, declined comment.
Daniels, 27, is under a court order and has been isolated in a jail ward at Maricopa Medical Center for 10 months, although he was not convicted or charged with any crime. Linda Cosme, an attorney for Daniels, said her client has been victimized by constitutional violations.
The ACLU should offer this guy shelter in their headquarters.

When you violate a public health order, you get treated like a criminal because you are a criminal.
Communicable diseases kill people. Spreading them is like arson, it’s not specifically intended to kill anybody, but it’s done with callous and atrocious disregard for human life.
Wasn’t this guy told not to travel (because of his highly contagious disease)on commercial transportation but decided to travel international anyway? From what I understand he knew about his condition and said %U anyway.
Not much different than someone with AIDS knowingly having sex without telling the partner.

This is a separate case from the one that has been in the news.
He is free to leave as soon as he signs the consent to voluntary incineration form.
This selfish creep doesn’t care if he kills scores of others as long as he has his freedom.
What’s the problem? Do you think the government should be able to detain you for the rest of your life without so much as a trial? We are talking about the gov’t folks. The same people who run the post office and the DMV. Are you really sure they are focused on making sure that they are only detaining you as long as necessary? Are you comfortable that if they order you detained that they won’t just forget about you?
Of course. If this guy was a Freeper, everyone would rail about the abuse of power and injustice of it all. It’s interesting to note that he’s not fighting to be released, just to get moved out of jail when he hasn’t been accused of a crime.
They ended up having to put him in a hospital room under 24 hour guard at taxpayer expense. They were paying sheriff's deputies hazardous duty pay to guard him.
He told me the deputies were under orders to use any force necessary to prevent him from leaving the room, and that the deputy was not required to put his own health in danger by grappling with the patient.
The guy apparently got the message when he tried leaving the room and the deputy drew his gun and told the guy to back away from the door or he would shoot. Starring at the wrong end of a .45 was apparently the proper motivation that he needed.
Well, Rodney, you can always offer to open your home so this fellow can be quaranteened there.
You can always open your home so he can be quaranteened there. Then you'll be responsible for keeping him (and your family) from going out in public and infecting others. Obviously, this guy can't handle doing that himself.
How does that even address the point? I take it then you are in favor of the government being able to detain you for an indefinite period without any sort of hearing or trial?

This is a different case than the resistant TB case which has been in the news lately. The local govt. has the guy in a jail (not a hospital) for his TB. Unless he has comitted a crime, I would have to reluctantly agree with the ACLU, as much as my common sense would tell me not to.....unless new facts come out or they are not as I understand them.
You’re missing the point. He’s not trying to get released. He also has not committed a crime.
