Dear Mr Robinson:

We are writing on behalf of our client, the Democratic National Committee (DNC).

A post by “coffee260” on FreeRepublic.com today states that this morning, on the Quinn & Rose show on XM, co-host Quin stated that the DNC chairman, Gov. Howard Dean had called Gov Kathleen Sebelius (D-Kans) “around 5:00am on morning after a tornado destroyed the town of Greensburg, Kansas and discussed with here what to say about the tornado and how to blame the war in Iraq and the Bush administration on a slow response to the aftermath.”

The statement was made by Mr Quinn, repeated on FreeRepublic, is demonstrably, unequivocally and absolutely false. Gov Dean had no such conversation with Gov Sebelius, ever.

No effort was made by FreeRepublic to contact anyone at the DNC for comment or to check the accuracy of these statements before they were published. FreeRepublic not only repeated this statement, but further stressed that Quinn’s “source” was extremely reliable and in a position that would give him direct knowledge of these revelations.

The statements quoted above are false and defamatory, are libelous and slanderous and clearly threaten to interfere with the DNC’s operations and ability to solicit support and raise funds by predjuding the organization in the eyes of the Democratic Party supporters and the public. For these reasons, we demand that FreeRepublic immediately cease and desist from Further dissemination of the above quoted statements or any statements similar in substance and immediately post a retraction of these statements in a location on its web pages at least as prominent as that on which the original story appeared.

Please let us know by noon, May 11, 2007, whether you intend to comply with these requests.

The geniuses at the DNC’s law firm are assuming that the Q&R show is produced by XM. It’s carried by XM, but the show originates from a terrestrial radio station that so far, apparently, their crack researchers have yet to discover. So I’m not surprised that Quinn hadn’t received the letter, at least by the time he wrote back to the FReeper who’d e-mailed him.

If in fact this email notice was a hoax, a fake, whatever, why would Admin/Jim Robinson allow us to continue on our merry way, believing it to be true? If that's the case, then it's Jim Robinson/Admin who have pulled the hoax on US (say 'prank' anyone?). I simply don't believe that could be. I would lose all faith in them as even handed moderators. And I think, so would a lot of other people.

That's a silly reply. The story is true. The poster heard the statements on the radio. The underlying events have not been verified but that's what investigative journalism is for.

Why is it the moderators job to determine the factuality of a news story? More to the point, this one as opposed to the hundreds of others posted daily?

There's no liability here, period. The statements are not slander/libel, even if they were to a 'normal' citizen - they don't rise to the level required for a public figure, and even still it's a Constitutional free speech issue.

Please don't throw me in that brier patch, Mr. Dean!

I'd say that another poster has mentioned this could be a setup. Maybe. The point would be to enforce the fairness doctrine against conservatives and attack the web at the same time. But it's not going to work, and will backfire.

The DNC has never been known for having Geniuses. Look who is the chairman. It is rather ignorant of them to make such a mistake. But then again, Dean thinks that Bush and the Saudis knew 911 was going to happen, and allowed it. Pretty much sums up the level of intelligence of the LW ;)

I know at least one of these pukes (at SANDLE, REIFF and YOUNG). Always thought of him as a neo-Stalinist. Now he proves it.

Without bothering to check deeply into my vast archive of draft memoranda I'm sure I can find one of their names as a recipient on one of my decisions telling them "final agency decision" ~ which means they had to go to court.

I think one of these pukes was involved in a rather infamous Jerry Falwell deal where Jer actually beat me in court ~ but that was only because his side opened their wallets for the suit and ourside sent in a US Attorney who was either drunk, asleep, or a member of Jer's congregation.

So, don't think of these guys as being primarily a "Democrat firm" ~ they are mostly hired guns prepared to advise their clients on how to gather money without guilt.

In order for this case to proceed, the DNC will have to prove the following:
1. A false statement
2. Published by the defendant
3. Of and concerning the plaintiff
4. By the defendant
5. Causing damages (economic or emotional)

I am not allowed to give legal advice, but that is what is at issue.

Well, whatever ~ still, it's good to get that feeling that the party of corruption, the Democrats, are living down to their name, and we may well get a chance to nail a Dem Governor and a Dem DNC Chairman at one fell swoop with a handful of really nasty felony charges.
