I’m cautiously optimistic over this news, but it over yet.
I want every one of those Troops released and I wont be happy until John Murtha is brought to justice.

Yes, it does. It’s good to see Phil Brennan continuing to report on the Haditha case.

Of course good news on these Haditha cases is always welcomed. It sure looks like all the involved Marines will walk free in due time. As for the deep hurt put into their souls as well as their families'...
Sadly the system will not change. Not in any meaningful significant way. A few may get slapped on the hands for screwing the pooch. But that is as far as it will probably go. Those crumb bums in the NCIS who willingly went along with some orders most probably to doctor how evidence was to be presented will most likely get pay raises and or promotions.
Those that perpetrated this terrible circus will waddle to their desks and have a scotch and say, damn that was a real pisser wasn't it.
Meanwhile. Our brave and honorable Marines, Soldiers, Airmen, Navy, Coast Guard and Aviators shall continue doing their jobs with commitement and honor and will uphold our constitution, and put their hides on the line in the call of duty.
God bless each one of the latter.

Wow..I hope this holds out. Newsmax doesn’t have a great track record, but this seems similar to some other reports coming out recently.

When asked by the prosecution team to give his copies of the evidence to the prosecution, he told NewsMax.com that he was reluctant to do so, fearing it would again be suppressed or misused, but later relented when ordered by his commanding general to do so.
Since the video and the radio transmissions are so compelling, why continue this charade ?
Does the defense have a right to all the evidence, even though some of it might be classified ?

You remember many members of the CIA undermining the Bush Administration because of political disagreements (leaks galore). It would surprise me little if some similar situational dynamics exists at NCIS - how many are from the Clinton years, for example, and etcetera?

If this is true the NCIS has a lot of explaining to do as well as murtha in disclosing who leaked the phony information to him.
Are there any FReeper Lawyer$ who can determine whether the familie$ might be able to file civil action$ again$t Congre$$man Murtha for hi$ ill advi$ed $landerou$ allegation$?
Thing$ could get co$tly for the Murth-Mei$ter!

I’m far from being a lawyer. I have seen some discussion on suits being brought against murtha on the forum by lawyers. Generally, elected officials are protected from them from what I’ve heard.
Frank Wuterich’s attorney did file a lawsuit agaist murtha for Wuterich last year, I believe for defamation of character. From what I gathered murtha may not be protected because he called them killers on a TV show and was not acting as a Congressman. I don’t believe it’s dropped but nothing has been said about it recently that I have heard.
It probably wouldn’t be prosecuted until after the Article 32 hearing or a courts-martial if that’s recommended anyway. That’s really all I know on the subject which isn’t a lot.

This is certainly good news, especially for Sgt. Dela Cruz.
However, it points to a bad trend lately."...exculpatory evidence that appears to have been obtained by the Naval Criminal Investigative Service (NCIS) and withheld from the prosecutors..."
Between this, and Nifong, and the Border Patrol agents case, I'm really getting the Clue that our whole justice system is seriously messed up. And the lawyers who populate it and run it (including the judges and law school professors, lawyers all) do not have any idea how to fix it, or even any awareness that it is broken.
If airliners were crashing with the regularity that highly publicized legal cases are going down in flames of lost credibility on the part of the government, hundreds or thousands of engineers, engineering professors, aerospace corporate execs, and so on, would be Working On The Problem.
Whenever there's some kind of Tainted Food scare, such as spinach or grapes or even pet food, we have hundreds or thousands of medical people, doctors, government food inspectors (remember the grape inspections?) Working On The Problem.
This is how the human race corrects things that are broken or messed up. We identify the problem, and people who are knowledgeable about it work together on it, and we fix it.
Why is it that the legal profession is such a bunch of slackers when it comes to Solving The Problem with their own profession? What makes them Special? Why can they screw up time after time after time (Border Patrol Agents still in prison, 7 of the Haditha 8 still under the gun, Vicki Weaver still dead, Waco still burned down, etc., etc., etc.), and Never take the slightest steps to investigate and correct the real problems?
