I just flipped through that listing of the enumerated powers of the Federal government detailed in Article 1 Section 8 of the US Constitution, and I don't see a word in there about 'demanding' background checks.

‘Negotiations’ with the ‘crats needs to be done like we ‘negotiated peace’ with the Japanese.

And you are absolutely right, the rules don’t mention anything about ‘checks’.

One other thing.

I don’t think that a single signer was actually a citizen at the time. So disarming ‘residents’ surely wasn’t their plan either.

The language is pretty darned clear - at least to me. And if I remember correctly, some of those ‘resident aliens’ back in the day actually owned BATTLESHIPS. If they had ‘Evil Assault Weapons’ you can bet your nation they would have used them to ‘Great Effect’.

I just read the Second Amendment againt and I don't see anything that limits the right to possess a firearm to law-abiding, mentally stable people. While that might be advisable in modern society, the mechanism for achieving that goal is not through legislation, but through a Constitutional amendment.

There's nothing in there about the Air Force either. You missed the commerce clause gives Congress the authority to regulate the sale of firearms. That means they can license dealers and creat regs regarding participants in any particular area, or item in commerce.

The fed 18USC922 gives a list of things that should disqualify folks from partaking in firearms transactions. As it is now, the States are requested to submit info regarding fed disqualifiers to the DOJ for entry into the NICS database. It's voluntary per 28CFR25.4 now.

In 2002 the house passed a bill to change that to must supply the info. Had that bill been passed by the Senate and signed by Bush, Cho's court record would have shown up and hte firearms transaction would have been denied. That would have been a good thing.

Do you see anything in the Constitution that prohibits sensible action like preventing homicidal maniacs from acquiring weapons? One of the cornerstones of operating a Republic is cultivating citizens that can effectively shoulder the responsibilities of citizenship. The mentally ill are not included in that genre.

If you check with the background information on the Second Amendment as written by the Founders, you will find references to "able-bodied" citizens. It is a safe bet that idea includes mental capacity. This is also a notion that appled to the "militia".
