Cho flunks the BATF form 4473, which specifically asks if you have been adjudicated mentally ill or committed to a mental institution. The definition of 'committed to a mental institution' covers a court order.

This person was illegally in possession of a firearm.

That wasn’t the fault of the firearms dealer, though. Cho simply lied/omitted in order to get the pistol(s).

Great post, Laz. That means his background check should have been declined.

Hear that, ATF?

Does the background check for a handgun purchase find this out, or does it only check for a criminal background? Do they just take the buyer's word on the Crazy/Not Crazy question?

That kind of puts the policy of no-gun campus in a strange light, doesn’t it? A guy with an illegally obtained gun was mowing down students whose RKBA was taken from them in the name of safety. Not a wise policy.

> This person was illegally in possession of a firearm.<

This is the kind of stuff that has to be caught by the instant background check. You can’t rely on the individual telling the truth. The trip to the mental hospital was voluntary, and thus was covered up to protect the poor dear’s privacy.

And now 31 innocent lives have been snuffed out.

Isn’t that a form with Check-off boxes?

I mena, if he checked “no” then how’s the gun dealer supposed to know?

This person was illegally in possession of a firearm.

I am sure the MSM will get around to figuring this out sometime around, oh ... *checks calendar* October or so.

Medical information is supposed to be under the privacy act unless a insurer wants it, then everyone is privy to it. There is no correlation/connection between the medical records and the ATF/FBI records anyway. The only way this can be coordinated is by insurance records with the ATF/FBI background checks.
