Two illegal aliens have agreed to a $100,000 out-of-court settlement after threatening a multimillion-dollar civil rights lawsuit against a Texas deputy over an incident in which the lawman shot at an alien-smuggling vehicle he said tried to run him down. Maricela Rodriguez-Garcia and Candido Garcia-Perez, Mexican nationals who were being smuggled into the U.S. in April 2005 when they were injured by fragments of the lawman's bullets, agreed to the amount after a mediation hearing in Austin, Texas. They initially asked for $1.5 million. Mrs. Rodriguez-Garcia, struck by bullet fragments in the cheek and mouth, and Mr. Garcia-Perez, injured when fragments hit him in the arm, had targeted Edwards County, Texas, Deputy Sheriff Guillermo F. Hernandez, saying he used excessive force in causing the injuries and that in firing at the vehicle abused his authority and grossly overreacted under the circumstances. Hernandez has been sentenced to prison in the incident. Edwards County Sheriff Donald G. Letsinger, who also was targeted in the pending lawsuit, said his deputy was cleared in an initial investigation by the Texas Rangers, which found that Hernandez "followed the letter of the law" in defending himself.

I expected this to happen. My guess is the lawyers knew a threat might get them a cash offer so that is what they wanted and got. My guess is they were told you better settle fast or you may only get medical costs because this took place while you were performing illegal activities.

Just another installment in the latest scam. I hate to say it but perhaps local law officers and landowners need to follow the SSS plan.

It’s not a question of who’s right or wrong anymore, only who has the ability to pay. In this case it’s the government again. Lawyers win.
If this sort of peverse ruling doesn’t have many more illegal Mexicans trying the same stunt to make a quick killing, I don’t know what will.
This will no doubt, set a precedent. They should never ever have settled!
Leave only a dead corpse. They can’t sue.
What has happened down in the border country is that Mexicans have infiltrated the legal system and are using the legal system to screw legal Americans. Its time to wake up and start taking action before we have to retake the border areas of our country. That includes L.A., San Diego in Calif. and the regions to the east.

There is a lot that doesn't make sense about what happened. The deputy claims the driver tried to run him down after he stopped and approached the driver.
Has anyone ever seen a cop go stand in front of a vehicle after they pull them over? Looks to me like the driver waited until the cop got up to his window and took off. The cop got angry and started firing at the vehicle as it sped away.
I'm not defending the perp, but we can't have cops who don't have enough control of their emotions that they can't stop from pulling their weapon and shooting because they get angry.
