Border Fence Builder Hired Illegal Immigrants

SAN DIEGO The owner of a company that once helped build a fence to keep illegal immigrants from crossing the Mexican border was sentenced Wednesday in San Diego to six months home confinement for hiring undocumented workers.

Mel Kay--founder, chairman and president of Golden State Fence Company--was sentenced along with a company manager, Michael McLaughlin. Both previously pleaded guilty to felony charges of knowingly hiring illegal aliens.

McLaughlin was also given six months home confinement by US District Judge Barry Ted Moskowitz. Each was ordered to log 1,040 hours of community service and spend three on probation.

Kay was also fined $200,000 as part of a plea agreement, and McLaughlin agreed to pay $100,000.

Federal prosecutors took the rare step of seeking prison time after the men acknowledged hiring at least 10 illegal immigrants in 2004 and 2005. The charges carried a maximum possible penalty of five years in prison.

However, prosecutors were unable to cite a single case in which an employer had been sent to jail for knowingly hiring illegal immigrants.

Nice to know the outcome of these cases ... though it is my belief that Golden State Fence deserved a more strident sentence and fine.

Until we make these busienssmen do the perp walk and put them in jail -- not home confinement -- we'll never get a handle on the problem.

Judge Barry M. is a solid and wise jurist. I have confidence that he fashioned to sentence to fit the nature, seriousness and intent of the wrong. The matter coming to court and a guilt sentence being known to the community is a really good thing for local morale and as a guidance to other judges.

Even though they did this, this law has never been enforced so dumping on the first guy is unfair. Good call by the judge.

Agreed.

It would be my preference that this company be barred from bidding on future government contracts. Perhaps that is the case but it's not reported.

I miss his show. He hasn't shown a new one in a while.

What is wrong with Comedy Central? They shelve all the really good shows into perpetuity and fill the time with reruns or junk!

What exactly is home confinement? Only going out to shop, run his business, and perform the community service hours? That's a lot of going out. Who monitors that he doesn't go the movies on the side?
