"The state bar is conducting a very thorough investigation into all aspects of Mr. Nifong's handling of the case," Freedman told ABC News. "It's appropriate for this to be dealt with by a North Carolina agency, not by someone from another state. I do not see the need for any other agency becoming involved at this point." Except the threat of a federal investigation will keep the state of NC from white-washing the investigation.

A Federal investigation can cause one other thing to be done to Nifong other than his being disbarred--it can cause him to be prosecuted criminally under the civil rights statutes. That's a very big thing since prosecutors are normally legally immune from any legal consequences for actions they take in the course of their employment. Equally important, such a prosecution opens up the possibility of successful civil actiions against Nifong by the three victims of his persecution.
