DOWNTOWN SAN DIEGO
A local Minuteman leader whose home was searched by San Diego police Wednesday has now been sued for defamation, along with an associate.
Joanne Yoon, a former San Diego State University student, filed the lawsuit yesterday in San Diego Superior Court against Oceanside resident Jeff Schwilk, founder of the San Diego Minutemen, and fellow anti-illegal immigration activist Ray Carney.
According to the complaint, Yoon, 24, was working as an independent contractor for the American Civil Liberties Union in San Diego last year. She monitored the activities of the Minutemen at day labor sites as a coordinator for the San Diego Legal Observer Coalition.
The suit, which includes a Web posting and e-mails allegedly written by the defendants, says that Schwilk and Carney repeatedly referred to Yoon in e-mails and on the Web in vulgar terms.
Neither Schwilk nor Carney could be reached for comment yesterday.
In the lawsuit, one Web posting attributed to them shows a photo of Yoon surrounded by day laborers, with the text insinuating that she is a prostitute: She really is popular or very inexpensive. (Hey Joe . . . Five Dolla-Five Dolla), the text reads.
Yoon is Korean-American.
The posting concludes with an offer of $50 to anyone who can find her home address.
Daniel Gilleon, a San Diego attorney representing Yoon, said his client, who now lives in Los Angeles, was attacked in terms of her race and gender.
She was scared, Gilleon said. Not that all Minutemen are this way, but Minuteman groups have provided racists a method of voicing their hate.
He said Yoon did not wish to comment on the lawsuit, which seeks $1 million in compensatory damages. The idea, he said, is to deter this kind of conduct.
Police served a search warrant at Schwilk's home this week, seeking evidence as part of an investigation into a vandalism attack on migrant worker camps that occurred in January. A search warrant was also served at the home of Julie Adams, a Rancho Peñasquitos woman. Police searched the home of Schwilk's ex-girlfriend Christie Czajkowski last month, confiscating computer and video equipment.

Liberals should fear precedence being set by this lawsuit as no one spews more defamatory hate than the typical liberal--anyway it's the $5 hookers of the world that should be offended by this.

Another slap suit by the ACLU fishing for a perch dinner in a goldfish bowl.
Claim the writing is satire, which is widely protected as free speech for the past 200 years.
Get a lawyer and countersue the ACLU for harassment.

Paint me stupid, but how does this constitute defamation? It just makes fun of her. I thought we had that free speech thingy....oh wait it only works if you're a liberal, non-christian or non-white. What has this country become? Political correctness sucks. I can't believe there's that many thin skinned people out there. I used to get made fun of, and then had to suck it up. But it made me a better person for it.

With a $ million lawsuit at stake, I guess the cyber talkers may be a bit sobered.
Aside from legalese, it is just good manners to observe restraint of tongue and pen. To practice the golden rule. etc.
Hate to break this to you, but suggesting a lady is a prostitute is STILL defamation and actionable. Having to put a high dollar amount on the damages sought is just a way to get the thing into federal court. There's nothing unusual about this suit really. Anyone calling a woman a whore on the internet SHOULD either back up their claims, or be sued. Sounds reasonable to me.
I loved this movie, it was very artistic - gay scenes, dance scenes, sex scenes, etc. I thought it was great. I can see why men wouldn't like it though. The battle scenes are very short, and there's too much talking in the film.

Doesn't meet the definition of 'defamation'.
"The main problem with proving defamation of character is the protection of free speech guaranteed by the First Amendment. Courts generally agree that an opinion, no matter how malicious, is not the same as a stated fact."
As the article states, there is an 'insinuation'. Not a statement of fact.
You also need to show actual damages. Either to reputation, character or monetary loss.
I doubt any of these things can be proven.
But it sure won't stop her.

This raises the suspicion that the ACLU has been taken over by the sort of people who are going to embarrass it out of business.
