ON CAPITOL HILL Valerie Wilson Testifies

Rep. Henry Waxman (D-CA) chairs a House Oversight and Government Reform Ctme. hearing on the disclosure of CIA Agent Valerie Plame Wilson's identity. The hearing will look into whether White House officials followed appropriate procedures for safeguarding the identity of Ms. Wilson.

Victoria was on Mark Levin show tonight pointing out that the email Valarie talked about was written on Feb 12th

VP Cheney didn't get his briefing till Feb 13th ... one later after the email was written

VT said she is surprised that no reporters except Byron York picked that up

Well, to be honest, I'm exluding 1500 Dems who know it, but are choosing to ignore it because it gets in the way of their attempts to bring down Bush.

I think I could vote for the devil himself before I could ever bring myself to vote for a Democrat-ick.

The United States has no "Official Secrets Act" like the United Kingdom and most other countries do.

If they did, many of the New York Times and Washington Post reporters would be sitting in jail as we speak. (And many would still be there from their past deeds. Cf. the "Pentagon Papers.")

That said, there are executive orders and various agency proscriptions against releasing classified material. Even Toensing seemed surprised that the CIA had not done anything about enforcing things that way.

But under the agency's rules Plame should have been punished for outing herself to Wilson on their second or third date.

She should have also been punished (or had her security clearances removed) for having an affair with a married man. Which Joe Wilson was in 1997.

Hey pinz...what about this for a conspiracy theory??

Some of us are suspicious that this was a "plan" from the get-go..that is why Plame suggested Joe the day BEFORE Cheney even asked about uranium in Niger..

Well...what if, this hearing was a sort of payback to PLAME, to help her civil case against Bush, Cheney, Rove???

According to David Corn, she might have had some trips overseas (despite her twins' age), to Jordan and possibly to Turkey on official CIA business (so, it wouldn't be classified in any normal sense as "covert", but then she says she could be "covert" at the same time as going to Langley every day, so, it's delusional)...

Corn in "What Valerie Plame Really Did at the CIA" offers this unflattering assessment of CIA's CPD before Iraq Freedom :

"We knew nothing about what was going on in Iraq," a CIA official recalled. "We were way behind the eight ball. We had to look under every rock." Wilson, too, occasionally flew overseas to monitor operations. She also went to Jordan to work with Jordanian intelligence officials who had intercepted a shipment of aluminum tubes heading to Iraq that CIA analysts were claiming--wrongly--were for a nuclear weapons program. (The analysts rolled over the government's top nuclear experts, who had concluded the tubes were not destined for a nuclear program.)

The JTFI found nothing. The few scientists it managed to reach ...

BTW, aluminum (dual-purpose) tubes were similar to those that were later found in Libya's WMD program. That tells me more than enough about incompetency of people in CPD (where Valerie was a group manager?) that we shouldn't have relied on their opinion, at least regarding nuclear WMDs, which weren't even the main type of existing WMDs we were looking at.

The reasons that they are so invested in and must insist on her having the "covert" status are :
1) to justify Fitzgerald's "investigation" - he knew better than to call her covert and kept calling her status "classified", which is nonsensical in government-speak, and has nothing to do with the statute.
2) to justify her and her hubby's civil lawsuits, otherwise it's a simple political matter, with no damages incurred. She, after all, quit CIA on her own volition, she wasn't fired, she could've stayed and continue driving to Langley as she did before, without being "covert". Her colleagues were not happy with her, though, because she was milking the situation for publicity and lawsuits.
3) without Valerie being "covert" Democrats can't continue with bogus "Bush-Cheney-Rove damage to national security" story line.

In other words, without "covert" the entire Plamegate "scandal" would turn the tables on Democrats and CIA leadership at the time - they can't afford to "lose" that. Republicans could make a lot of progress today, like Victoria did, or at least tried to do without any support from "not present" GOP Congresschickens, by shredding this "covert" story to bits.

We beat up on Bush (often with reason) but 2006 election results happened the way they did simply because of GOP Congresschickens, just coming home to roost. If they keep it up, they'll have an encore in 2008.

If the Wilsons lose their law suit does it mean that its a settled issue as to whether she is covert or not?

Also if the suit goes forward will it open up this bag of worms?

Even if Plame was covert, for their to be a crime for Fitzgerald to prosecute 1) the government official would have to know that she was covert and 2) that the CIA was actively trying to keep her status secret:

US CODE: Title 50,421. Protection of identities of certain United States undercover intelligence officers, agents, informants, and sources

Whoever, as a result of having authorized access to classified information, learns the identify of a covert agent and intentionally discloses any information identifying such covert agent to any individual not authorized to receive classified information, knowing that the information disclosed so identifies such covert agent and that the United States is taking affirmative measures to conceal such covert agent’s intelligence relationship to the United States, shall be fined under title 18 or imprisoned not more than five years, or both.

In fact, Novak talked to the CIA and they confirmed to him that she worked at the CIA.

So, so much for #2.
