If there is a violation of the possession limits on board a vessel carrying more than one person, the violation shall be deemed to have been committed by the owner or operator of the vessel.

Don't know what it's like today, but 30 or more years ago they were handing out '6 pack' tickets like penny candies. A lot of folks back then got licenses who had no business even being on the water, but IIRC there were big tax advantages in it. Sounds like someone just hung on to the ticket and didn't bother to keep current with the laws.
